This case of the petitioner is that respondent-police illegally detained the vehicle under Registration No.DL-01-CR-5899-120 MAGNA CRDI- 2016 MODEL, belongs to mother of the petitioner by name Reena Bandlish, under Drunken and Drive case under Sections 185(a), 130/177, 207 of M.V.Act against the petitioner without any jurisdiction. Hence, the present writ petition is filed seeking direction to respondents to release the subject vehicle.
Learned counsel for the petitioner submits that in similar circumstances, this Court disposed of WP.No.15643 of 2019, dated 2507-2019. The same is not disputed by learned Assistant Government Pleader for Home.
Though the petitioner filed writ petition, the subject vehicle registered in the name of his mother.
In view of the same, for the reasons alike in the said order, this writ petition is disposed of directing the mother of the petitioner to appear before the 5th respondent with RC book relating to subject vehicle and also producing proof of her identity and thereupon the 5th respondent or other official who has the custody of the subject vehicle shall release the same to the mother of the petitioner forthwith.
