Chowdary Satya Rao, v. The State Of Andhra Pradesh,
HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.41532 of 2016 ORDER:
1.
This writ petition is filed by the petitioner under Article 226 of the Constitution of India challenging the appointment of respondents Nos.6 to 11 to the 5th respondent-temple as trustees for a period of two years. 2.
Heard and perused the material available on record. 3.
It is brought to the notice of this Court that the petitioner filed WP No.27701 of 2015 before this Court challenging the action of the Commissioner of Endowments, in issuing notice dated 6.8.2015 proposing to appoint a Board of Trustees. In the said writ petition, this Court while ordering notice before admission passed the following order: "Any appointment of the Board of Trustees in pursuant to the impugned notification dated 6.8.2015 shall abide the result of the writ petition."
In view of the above orders in W.P.No.27701 of 2015, this Court is of the view that the question as to whether the appointment of respondents Nos.6 to 11 as trustees is legal or illegal can be agitated in W.P.No.27701 of 2015.
4.
Accordingly, the Writ Petition is dismissed. No costs. Consequently, miscellaneous petitions pending, if any, shall stand dismissed. ________________ RAJA ELANGO, J Date: 30th November, 2016 Nn
