THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.9158 of 2016 ORDER:
This Criminal Petition is filed under Section 482 Cr.P.C. to quash the proceedings in M.C.No.152 of 2015 on the file of Metropolitan Sessions Judge for trial of JHBBC, XXIII ACJ, cum Family Court, Nampally, Hyderabad.
Heard the learned counsel appearing for the petitioner/Respondent and the learned Additional Public Prosecutor representing the State.
The contention of the petitioner is that the marriage between the petitioner and 2nd respondent is not in dispute and that the 2nd respondent having filed several cases including the one in hand is not leading evidence and proceeding with the trial of the case and unnecessarily protracting the litigation thereby harassing the petitioner to go around the Courts.
In that view of the matter, the criminal petition is disposed of directing the learned Sessions Judge, to dispose of M.C.No.152 of 2015 as expeditiously as possible, preferably within a period of two (2) months from today.
Pending miscellaneous applications, if any, shall stand closed in consequence.
