HON'BLE SRI JUSTICE S. RAVI KUMAR SECOND APPEAL No.144 of 2000 JUDGMENT:

This second appeal is preferred challenging the decree of the II Additional District Judge, Rajahmundry, E.G. District, dated 10.08.1999 in A.S.No.67 of 1992, whereunder judgment dated 27.03.1993 in O.S.No.189 of 1985 on the file of the Principal District Munsif, Rajahmundry, is modified directing the plaintiff to pay tax at Rs.1,500/- for half year for the assessment year under Ex.A.1 deducting the amount already paid.

2. Respondent herein filed the above suit challenging the special property tax notice dated 30.03.1985 issued by appellant herein and the trial Court decreed the suit holding that the special notice is void.

3. Heard arguments.

4. Advocate for respondent/plaintiff represented that plaintiff has paid the amount as demanded in the special notice and as such the second appeal has become infructuous, which is not disputed by other side.

5. Considering the same, this second appeal is dismissed as infructuous.

6. Miscellaneous Petitions pending, if any, shall stand closed. No costs.
