HONOURABLE JUSTICE G. SRI DEVI CRIMINAL REVISION CASE No.918 of 2019 ORDER:

This Criminal Revision case is filed under Sections 397 (1) and 401 Cr.P.C. challenging the judgment, dated 01.02.2018 in Criminal Appeal No.362 of 2017 on the file of the Special Judge for Economic Offences-cum-VIII Addl. Metropolitan Sessions Judge, Hyderabad, in confirming the judgment, dated 28.02.2017 in C.C.No.310 of 2015 on the file of the XV Addl.

Chief Metropolitan Magistrate, Hyderabad, wherein the accused was convicted for the offence punishable under Section 138 of the Negotiable Instruments Act, 1881 and sentenced to undergo Imprisonment for three months and also to pay fine of Rs.1,00,000/-, in default to suffer Simple Imprisonment for one month.

2. Today, both parties are present before this Court and they are identified by their respective counsel. This Court, when examined, both parties have stated that at the instance of the elders, they have settled the matter out of the Court and the 2nd respondent has no objection to allow the Criminal Revision Case.

3. In the light of the compromise arrived at between the parties, the compromise is recorded.

4. Accordingly, the Criminal Revision Case is allowed setting aside the conviction and sentence recorded against the accused by the XV Addl. Judge-cum-XIX Addl. Chief Metropolitan Magistrate, Hyderabad, vide judgment, dated 28.02.2017 in C.C.No.310 of 2015 for the offence punishable under Section 138 of the N.I. Act and as confirmed by the Special Judge for Economic Offencescum-VIII Addl. Metropolitan Sessions Judge, Hyderabad, vide judgment, dated 01.02.2018 in Criminal Appeal No.362 of 2017. The accused is acquitted of the offence punishable under Section 138 of the N.I. Act. The bail bonds of the accused, if any, shall stand cancelled. The accused is directed to pay costs of Rs.5,000/- (Rupees five thousands only) to the Legal Services Committee, Hyderabad, within a period of one week from the date of receipt of a copy of this order.

Miscellaneous petitions, if any pending shall stand closed.
