THE HON'BLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioners claim to be the residents of Gorantla Village and Mandal, Ananthapur District. According to the petitioners, there is a connecting road to the State Highway between Bangalore and Puttaparthi and this road is used by the villagers to reach to their farm lands, for the students to go to the schools and by general public for commutation. Petition villagers apprehend that there is an endeavour made by some land grabbers to grab this land and close the road and in such event, great prejudice would be caused to them. Alleging that such attempts are being made, some of the villagers made representation on 12.02.2018 to the Tahsildar, received by him on the same date. Alleging inaction on the representation made and that the attempt to grab the Rasta land, this writ petition is filed.

Having regard to the nature of grievances expressed, I deem it appropriate to direct the Tahsildar to examine the grievance, if necessary, by conducting field inspection and verify whether the Rasta is in existence, which is used by the general public and if so, is there any attempt made by persons unconcerned with the property to encroach into the Rasta.

It appears from the averments filed in support of the writ petition and the array of parties to the writ petition and according to the petitioners, respondents 4 to 6 are attempting to encroach into the alleged existing Rasta. If that is so, the Tahsildar shall also put on notice respondents 4 to 6 or any other person who has interest in the property, conduct due verification in their presence and take suitable decision as warranted by law, after affording due opportunity to all and communicate the decision to the petitioners or to the effected parties, as the case may be. The exercise shall be completed within a period of eight weeks from the date of receipt of copy of this order.

Accordingly and with the above direction, this writ petition is disposed of. Miscellaneous petition pending consideration, if any, in this case shall stand closed as consequence. There shall be no order as to costs. ___________________ P.NAVEEN RAO, J 26.04.2018 SS
