ORDER

This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused No.1 in Crime No.37 of 2026 before the Doulthabad Police Station, Vikarabad District, registered for the offence punishable

under Sections 109, 118(1), 126(2), 351(2) read with 3(5) of BNS.

The brief facts of the case are that on 01.04.2026 at about 17:00 hours, a written complaint was lodged by the complainant stating that tractors had been unlawfully passing through his agricultural land, causing damage to the soil and field. Despite prior warnings, on 27.03.2026, when he questioned the same, he was abused by accused persons. Later, while proceeding towards his field, he was wrongfully restrained by A-2, and A-1 allegedly came on a motorcycle and hit him from behind with an intention to kill. Both accused then attacked him, and A-2 allegedly threw a stone causing head injury, while A-1 attempted to assault him with a boulder. The complainant was rescued by locals and shifted to Government Hospital, Tandur.

Heard Sri R. Prasanth, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner is innocent and has been falsely implicated in the case and that he belongs to a respectable middle-class family with no criminal antecedents. He further submitted that the investigation is substantially completed and material witnesses have already been examined, and therefore, there is no possibility of tampering with evidence. The counsel argues that except for the alleged confession, which has no evidentiary value in law, there is no material connecting the petitioner to the offence. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this Criminal Petition.

Learned Additional Public Prosecutor opposes the bail application contending that the allegations against the petitioner are serious in nature, involving an attempt to cause fatal injuries to the complainant and that the petitioner actively participated in the offence by hitting the complainant with a vehicle and attempting further assault. At this stage, granting of bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it appears that the petitioner is in jail since 02.04.2026. As seen from the record, the material part of the investigation has been completed and L.Ws.1 to 12 witnesses have been examined.

Considering the facts and circumstances of the case and the incarceration period of the petitioner, this Court deems it fit to grant bail to the petitioner, subject to the following conditions: i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the Judicial Magistrate of First Class, Kodangal.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of

investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
