ORDER

The petitioner herein is the temporary fair price shop dealer for fair price shop No.2, Garladinne Village and Mandal, Anantapur District.

It is evident from the record that the petitioner was appointed as a temporary dealer pending taking up of regular appointment of a dealer. The petitioner had earlier approached this Court in W.P.No.39852 of 2014 alleging that the respondents are trying to terminate his dealership. In the said writ petition while issuing notice, this Court by order dated 26.12.2014 directed that the petitioner shall be continued as temporary fair price shop dealer and he shall be allotted essential commodities for distribution. The petitioner has been continuing as such since then. The petitioner questioned the notification dated 2.3.2015 issued by the Revenue Divisional Officer, seeking to make regular appointment of fair price shop dealer to the said shop, on the ground that there was no notice to him.

I am unable to see as to how the petitioner, who is temporary dealer, is required to be notified before taking up proceedings for appointment of regular dealer as mentioned above. The petitioner's appointment itself is upto the appointment of regular dealer.

petitioner, which requires to be entertained by this Court, at this stage. The petitioner, however, is at liberty to apply in response to the said notification, if he is otherwise eligible, and his case also deserves to be considered along with other candidates, keeping in view of his temporary dealership. The petitioner's temporary dealership also shall be continued till the regular appointment is finalized.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
