Heard Ms.Thakur Roopa Singh holding for Mr.A.Ravi Shanker for petitioners and the Assistant Government Pleader for respondents 3 to 5.
The petitioners claim to be in possession and enjoyment of H.No.3-29, Sreemukhalingam Village, Jalumuru Mandal, Srikakulam District. The petitioners complain in the instant writ petition that respondents 3 to 5 are proceeding to demolish the structures covered by H.No.3-29 or dispossess the petitioners from the house in their possession and enjoyment for several decades. The steps against which complaint is made in the instant writ petition are taken up without recourse to law. Hence, the writ petition. The Assistant Government Pleader for Revenue submits by referring to written instructions that the petitioners are encroachers of temple property and the constructions in existence are contrary to the Ancient Monuments and Archaeological Sites and Remains Act, 1958.
The authorities are trying to protect the monument and in the process, if enjoyment is found to be objectionable, it is submitted that the respondents will follow the procedure, afford opportunity, pass orders and thereafter dispossess or demolish as the case is. The statement is placed on record and accepted. The writ petition is disposed of accordingly. No order as to costs.
