The petitioner challenges the suspension order dated 0404-2018. On the same date, the petitioner was issued charge memo and he submitted explanation to the same. But the petitioner has been continued under suspension. Learned counsel for the petitioner says that without conducting any breath analyzer test, only on the bare allegation that the petitioner was in intoxicated condition while performing duty, he was suspended.

Heard Sri N.Vasudeva Reddy, learned Standing Counsel for the respondent-Corporation.

The truth or otherwise of the allegations can be gone into in the enquiry. The petitioner was also issued charge memo and he submitted explanation. Ordinarily this Court will not interfere with the order of suspension, unless the same is issued without jurisdiction is arbitrary. It is not the case of the petitioner that the impugned order is without jurisdiction. The petitioner was suspended on serious allegations i.e. attending duty in intoxicated condition.

In view of the same, I do not see any reason to interfere with the order of suspension. However, the respondents are directed to conclude the enquiry within a period of two months from the date of receipt of a copy of this order.

Accordingly, the writ petition is dismissed. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
