When the matter was taken up for hearing on 14.11.2018, as none appeared, it was directed to be listed under the caption 'For Dismissal' on 22.11.2018. The matter was adjourned on 29.11.2018. Even today, when the matter is taken up for hearing, neither the petitioners appear nor there is any representation on their behalf.

The Supreme Court in K.G. KERALAKUMARAN NAI R v . STATE OF KERALA 1 and RAM NARESH YADAV v . STATE OF BI HAR2 observed that the High Court has power to dismiss an appeal or any other criminal proceedings for default. In view of the above, the criminal petition is dismissed for non-prosecution. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
