THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO I.A.Nos.2 and 3 of 2018 in/and Criminal Petition No.4915 of 2018 ORDER :

The petitioner is the accused in P.R.C.No.2 of 2018 on the file of the 1st Chief Metropolitan Magistrate(for short, '1st CMM') at Visakhapatnam City outcome of Cr.No.352 of 2016 of Gajuwaka Police Station registered for the offence punishable under Section 366-A IPC on the report of the 2nd respondent-defacto-complainant.

The very affidavit filed as if of the 2nd respondent through notary from the very incomplete thumb impression doubts the genuineness as already pointed out by the learned Public Prosecutor from the report of the Inspector, Gajuwaka Police station of Visakhapatnam city of 2nd respondent/ defacto-complainant-mother of the victim-3rd respondent of the quash petition was hale and healthy and she and her husband are doing cooli works on the pretence of not doing well and not in a position to come, thereby cannot be believed. However, the fact remains from what the victim girl now major says the accused is innocent and a case was registered under certain circumstances and her parents are not willing for withdrawal for that the accused cannot suffer, thereby it is her endeavour to compromise the matter and compound the offences.

By considering the above facts, both the parties who are present along with their counsel are permitted to compound the offences. In the result, the I.A.Nos. 2 and 3 of 2018 are allowed. Consequently, the Criminal Petition is also allowed quashing the proceedings against the petitioner/ accused in P.R.C.No.2 of 2018 on the file of the 1st CMM at Visakhapatnam City outcome of Cr.No.

Station. The accused is acquitted and his bail bonds shall stand cancelled. Pending miscellaneous petitions, if any, shall stand closed. _________________________ Dr. B.SIVA SANKARA RAO J, Date:23.11.2018 vvr
