HON'BLE SRI JUSTICE SANJAY KUMAR Writ Petition No.20364 of 2012 O R D E R:

The petitioner assails the action of the police authorities in continuing a rowdy sheet against him in spite of his acquittal by the competent Criminal

Court.

Initially, the Inspector of Police, Hussaini-Alam Police Station, Hyderabad, filed a counter affidavit stating that the petitioner was involved in as many as six (6) criminal cases owing to which a rowdy sheet was opened against him in February, 2007. He further stated that though no cases were pending against the petitioner as on the date of the said counter affidavit, public interest required the police authorities to continue the rowdy sheet against him as Hussaini-Alam Police Station has jurisdiction over certain sensitive areas. This counter affidavit was filed on 31.7.2012. Thereafter, an additional counter affidavit was filed by the Inspector of Police, Hussaini-Alam Police Station, Hyderabad, stating that Crime No.136 of 2013 was registered against the petitioner on the complaint made by one Smt. C.

Sudha Laxmi, resident of Pardhiwada, Puranapool, Hussaini-Alam, Hyderabad. The Inspector further stated that the petitioner was a habitual offender and as he was involved in Crime No. 136 of 2013, it was not possible for the police authorities to consider his request for closure of the rowdy sheet.

Neither Sri Immaneni Ramarao, learned counsel for the petitioner, nor the learned Assistant Government Pleader for Home are in a position to state as to what happened thereafter in so far as Crime No. 136 of 2013 is concerned. In any event, it is for the police authorities to consider the request of the petitioner to close the rowdy sheet opened against him in accordance with the rules obtaining presently.

The writ petition is accordingly closed leaving it open to the petitioner to apply to the police authorities for closure of the rowdy sheet opened against him if warranted on facts and as per the existing law. In the event the petitioner makes such a representation, it is for the police authorities to consider the same and pass appropriate reasoned orders thereon in accordance with law. Pending miscellaneous petitions shall also stand closed. No order as to costs.
