JUSTI CE SHAMEEM AKTHER W RI T PETI TI ON No.1 7 1 2 6 of 2 0 1 9 ORDER: { Per the Hon'ble the Chief Justice Sri Justice Raghvendra Singh Chauhan} The petitioner has filed this Habeas Corpus writ petition ostensibly on the ground that her husband, Mr. Maniam Suman, is being illegally detained by the police.

However, Mr. Sripathi Santosh Kumar, learned counsel for the State, informs this Court that on 12.07.2019 one Sri Bhanuchandra Suman Samayamanthri had lodged an FIR with the Police Station, Bachupally. In connection with the said FIR, the detenu was arrested on 07.08.2019. He was produced before the II Additional Junior Civil Judge - cum - X Metropolitan Magistrate, Kukatpally, Cyberabad, on 08.08.2019. The learned Judicial Magistrate has remanded the detenu to judicial custody. Therefore, according to the learned counsel, the present custody of the detenu is not an illegal one. 3.

The facts, narrated by the leaned counsel for the State, have not been challenged by the learned counsel for the petitioner. 4.

Since the detenu is presently in judicial custody, obviously, his custody is a legal one. Therefore, this Court does not find any merit in this Habeas Corpus writ petition. It is hereby dismissed. Pending miscellaneous petitions shall stand closed. There shall be no order as to costs.
