THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 17146 OF 2019 O R D E R :

This writ petition is filed challenging the action of the respondents in converting the petitioner's electricity service connection vide S.Nos.S9001233, S 9028325, S 9028328, S 9028322 and S 9028324, into B2 Commercial Category.

Learned Counsel for the petitioner submits that without issuing any notice to the petitioner, the respondents have converted the petitioner's electricity service connections from residential category to commercial category.

Sri R.Vinod Reddy, learned Standing Counsel for respondents submits that admittedly, petitioner is using her property for commercial purposes, as such, petitioner's electricity service connections were converted into commercial category. According to Clause 3.4.1 of the General Terms and Conditions of Supply, it provides for issuance of notice before conversion of category of service connections.

In view of the same, without expressing any opinion on merits, the writ petition is disposed of directing the competent authority to issue notice to the petitioner before effecting conversion of the petitioner's electricity service connection into commercial category. Till such exercise is done, petitioner's service connection need not be

disconnected treating the same as commercial. However, in pursuance of the notice, the petitioner shall cooperate with the enquiry, otherwise, it is open for the respondents to pass appropriate orders and take action. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
