This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking the Court to grant anticipatory bail to the petitioner/Accused in the event of his arrest in connection with Crime No.591 of 2026 of Medipally Police Station, Medchal-Malkajgiri District. The offences alleged against the petitioner are under Sections 69 of BNS.

The facts of the case are that the complainant has been in a relationship with the petitioner since the year 2015. He repeatedly promised to marry her. Based on his promise of marriage, he convinced her to enter into a live-in relationship and a physical relationship at his residence in Boduppal, in the absence of his parents. The complainant consented to the relationship solely due to his continuous assurance of marriage. After a prolonged period of emotional and physical involvement, he has now refused to marry her and has cut off communication. She strongly believes that the accused intentionally deceived and exploited her on a false promise of marriage. Hence, requested the police to take necessary action basing on which the present crime is registered. 3.

Heard Sri Salimoddin, learned counsel appearing for the petitioner and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondent - State. 4.

The learned counsel for the petitioner submits that there was no false promise of marriage at any point of time. The alleged relationship was purely voluntary and mutual, arising out of love and affection between the parties. It is further submitted that no false promise was made by the petitioner. As

such, he prayed the Court to grant pre‐arrest bail to the petitioner by allowing the present Criminal Petition. 5.

On the other hand, the learned Additional Public Prosecutor opposed the bail, contending that the offence committed by the petitioner is heinous and grievous in nature. There was a long relationship between the parties and the petitioner herein cheated the de-facto complainant. Therefore, the petitioner is not entitled to bail and prayed for the dismissal of this petition.

Considering the submissions made by the learned counsel for the petitioner and the learned Additional Public Prosecutor, and upon perusal of the material placed on record, this Court observes that both parties have been in relationship since 2015 and no such complaint was filed earlier. Now, after a delay of 11 years, the complaint has been filed by the victim. In view of the above facts and circumstances of the case, this Court deems it appropriate to grant anticipatory bail to the petitioner, subject to the following conditions:

i.

The petitioner shall surrender before the Station House Officer, Medipally Police Station, Medchal - Malkajgiri District within two weeks from today, and on such surrender, the said Station House Officer

shall release the petitioner on bail on his executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for the like sum each.

ii.

The petitioner shall appear before the concerned SHO between 09.00 a.m and 05.00 p.m., on every Monday for a period of eight (8) weeks, for the purpose of investigation or till filing of charge sheet whichever is earlier and thereafter, as and when required.

iii.

The petitioner shall abide by the other conditions stipulated in Section 482 (2) of BNSS and co-operate with the Investigating Officer in investigating the case. 7.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
