HONOURABLE SRI JUSTICE M.SATYANARAYANA MURTHY TRANSFER CRIMINAL PETITION No.281 OF 2016 ORDER:

This Transfer Criminal Petition is filed under Section 407 (1) of Cr.P.C. seeking to order withdrawal of C.C.No.392 of 2016 pending on the file of VI Additional Chief Metropolitan Magistrate, Visakhapatnam on the ground that the 2nd respondent herein who filed the complaint for the offence under Section 138 and 142 of the Negotiable Instruments Act did not turn up for cross-examination as she was 70 years old.

But it is not a ground to withdraw and transfer the matter at the inconvenience of the party though it is exception to rule of territorial jurisdiction.

However, taking into consideration of the facts and circumstances of the case, I deem it appropriate to direct the VI Additional Chief Metropolitan Magistrate, Visakhapatnam to fix a specific date for the adjournment of the witnesses and for cross-examination, otherwise proceed in accordance with law closing the evidence if permits.

With the above direction, this Criminal Petition is disposed of. As a sequel to the disposal of this petition, the Miscellaneous Petitions, if any, pending, shall stand dismissed. __________________________________ JUSTICE M.SATYANARAYANA MURTHY Dated 8-11-2016.
