The case of the petitioner is that the petitioner while working as Senior Assistant retired from service on 30-09-2011 and despite acquittal in criminal case in C.C.No.8 of 2011 dated 09-01-2017 by the Principal Special Judge for SPE & ACB Cum IV Additional Chief Judge, CCC, Hyderabad and despite exonerating the petitioner in departmental proceedings in G.O.Rt.No.360, Revenue Department, dated 19-03-2014, pension of the petitioner is not released. Aggrieved by the same, the petitioner made representations on 12-03-2017 and 24-04-2017. But as on today, no action is taken for release of pension. Aggrieved by the same, the present writ petition is filed.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Services.

Since disciplinary proceedings initiated against the petitioner and criminal proceedings are stated to be dropped by the Government in G.O.Rt.No.360, dated 19-03-2014, the respondents cannot deny the pension of the petitioner. In view of the same, the competent authority is directed to consider the representations of the petitioner and take action for release of pension and terminal benefits of the petitioner in accordance with law. Said exercise shall be done within a period of six weeks from the date of receipt of a copy of this order.

With the above observation, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 22-09-2017 Nvl
