THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.4903 OF 2018 ORDER:

The petitioner, who is A.4 in Crime No.13 of 2017 of Bhongir Town Police Station, Nalgonda District registered for the offence punishable under Section 447, 427, 386 and 120-B of the Indian Penal Code, 1860 (for short 'I.P.C.'), filed this criminal petition under Section 438 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.') to issue a direction to the Station House Officer to release him on bail in the event of his arrest in connection with the above crime.

The allegation made against the petitioner is that in the year 2005, he, being a member of Nayeem gangster, forcibly obtained document from the de facto complainant with threat and took possession of the land to an extent of 180 square yards in Sy.No.589. Basing on these allegations, the police registered the crime and issued F.I.R.

The petitioner was a member of Nayeem gang a notorious gangster, who obtained various documents from various persons in and around the Hyderabad city and it is an undisputed fact that the petitioner obtained documents from the de facto complainant and that it was obtained forcibly.

Hence, taking into consideration of the gravity and seriousness of the offence and its impact on the Society, I find that it is not a fit case to grant pre-arrest bail.
