HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Criminal Petition No.4852 of 2017 ORDER:

In this petition filed under Section 438 Cr.P.C, the petitioner/A.3 seeks pre-arrest bail in Crime No.17 of 2016 of Jaddangi P.S, East Godavari District which was primarily registered under Sec.174 Cr.P.C and later altered to Sec.323, 509, 354-A, 306 IPC and Sec.3 (1)(r)(s), 2(v)(va) of SC & ST (PO) Act, 1989 (amended Act 1 of 2016). 2) The deceased-Kosuri Venkata Lakshmi was working in Jaddangi Primary Health Centre (PHC) on outsourcing basis since last 10 years. The petitioner/A.3 has been working as MPHEO in the said PHC. The allegations are that A.3 was moving after the deceased and harassing her to quench his lust, which she refused. As such he was harassing her and insulting her. Ultimately unable to bear insults, it is alleged, she committed suicide on 02.07.2016 by consuming some pills.

Investigation is reported to be pending.

3) A perusal of the 161 Cr.P.C statements of the witnesses which include the co-employees of the deceased shed a strong prima facie case against the accused. Investigation is still pending. Having regard to the gravity of the offence and pending investigation, it is not a fit case to grant bail to the petitioner/A.3.

4) Hence while dismissing the bail application, the petitioner/A.3 is directed to surrender before the concerned Court and seek for regular bail

in which case, the concerned Court shall dispose of his bail application on merits on the same day.
