HON'BLE SRI JUSTICE A. SHANKAR NARAYANA Tr.C.M.P.No.442 OF 2016 ORDER:

The present transfer petition, under Section 24 of the Code of Civil Procedure, 1908, is filed seeking to withdraw H.M.O.P.No.29 of 2016 from the file of learned Senior Civil Judge, Sattenapalli, Guntur District, and transfer the same to the file of Senior Civil Judge, Suryapet.

2. Heard Sri V. Brahmaiah Chowdary, learned counsel for the petitioner - wife, and Sri Kowturu Pavan Kumar, learned counsel for the respondent - husband.

3. Learned counsel for the petitioner would submit that the petitioner has got a small child and on account of the harassment meted out to her by the respondent and his parents, she has been taking shelter at her parents' house in Durajpalli Village, Cherlavel Mandal, Suryapet District Munsif Court Jurisdiction, and it is difficult for her to attend the Court at Sattenapalli, Guntur District, with the minor child and without any male assistance.

4. Whereas, the learned counsel for the respondent would oppose the request contending that the relations of the petitioner, in fact, beaten the respondent and, therefore, it is not proper for the petitioner to seek the present request.

5. When, kept in view, the fact that the petitioner has to look after the minor child and she has no proper male assistance to attend the Court at Sattenapalli and as it would not cause any hardship to the respondent, if he attends the Court at Suryapet, the request of the petitioner can be acceded to.

6. Hence, the present transfer petition is allowed. Consequently, H.M.O.P.No.29 of 2016 pending on the file of learned Senior Civil Judge, Sattenapalli, is withdrawn and transferred to the file of learned Senior Civil Judge, Suryapet, for disposal in accordance with law. The transferee Court shall issue notices to the parties on receipt of the case bundle.

Miscellaneous Petitions, if any, pending in this transfer petition shall stand closed. There shall be no order as to costs. ___________________________ A. SHANKAR NARAYANA, J April 17, 2018.
