This writ petition is filed aggrieved by endorsement in N.Dis.D/39/2019, dated 28-02-2019, wherein and hwereby the appeal filed by petitioner was returned on the ground that Director of Settlements is not competent authority to entertain the same. Learned counsel for the petitioner submits that the similar issue is dealt with by this Court in WP.No.25392 of 2008, dated 23.01.2012 and he filed a copy of the order at page No.12 of material papers. Learned Government Pleader for Social Welfare has not disputed the same.

In view of the same, the impugned order is set aside. The 3rd respondent is directed to dispose of the appeal filed by petitioner in accordance with law.

Accordingly, the writ petition is allowed. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
