THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 17169 of 2019 O R D E R:

The apprehension of the petitioner in this writ petition is that in spite of the judgment and decree dated 16.02.2005 passed by the learned Senior Civil Judge, Narayanpet, in O.S.No.97 of 1999, against Nos.5 to 8 and the same was confirmed in A.S.No.19 of 2005 on the file of I Additional District Judge, Mahabubnagar, respondent No.4-Tahsildar is not considering the application dated 05.08.2019 for issuance of pattadar pass book. In the light of the nature of relief sought by the petitioner, it is not necessary for this Court to issue notice to respondent Nos.5 to 8. In terms of Section 4 of the A.P. Rights in Land and Pattadar Pass Books Act, 1971 read with Rule 9 of the A.P.

Rights in Land and Pattadar Pass Books Rules, 1989, when an application is considered for mutation of the names on the basis of a Court order, the Tahsildar is required to consider the rights of the respective parties as determined in the Court order. Admittedly, as on date, respondent No.4 is yet to consider the respective claims. In view of the same, respondent No.4 shall take into consideration the Court order and pass appropriate orders in accordance with law. Subject to the above, the writ petition is disposed of. Miscellaneous petitions, if any, pending in this writ petition shall also stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:13.08.
