THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.17491 of 2016 ORDER:

The petitioners state that they were appointed as II ANM on outsourcing basis and were posted at Sub Centres Ammavaripalem and PHC Ramapuram of Tada Mandal, SPSR Nellore District in the year 2008. They have been working for the last eight years. While so, the third respondent appears to have issued a paper statement for filling up of 145 ANM posts for a period of one year on contract basis and invited applications. The said action of the third respondent is challenged in this Writ Petition on the ground that the third respondent issued paper statement without any financial consent from the Government and without according permission by the first respondent. It is also the case of the petitioners that no opportunity was given to them and others to regularize their services on permanent basis.

A perusal of the orders of appointment dated 01.03.2008 and 30.12.2008 shows that the petitioners were appointed on outsourcing basis for a period of one year. The order of appointment was issued by the Member Convenor, Rogi Kalyana Samithi (HDS), which is not a Government Organisation. The appointment was only on temporary basis. When the third respondent is taking steps for filling up of ANM posts, the petitioners cannot stop the process on the ground that they were not made permanent. If the petitioners are otherwise eligible, they can also apply for the posts which are sought to be filled up by the third respondent.

In the circumstances, this Court sees no ground to grant the relief as prayed by the petitioners in the present Writ Petition and the Writ Petition is, accordingly, dismissed at the admission stage. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
