THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.29257 of 2015 ORDER:

Heard the learned counsel for petitioners and the learned Government Pleader for Civil Supplies for respondents.

The petitioners are existing fair price shop dealers of shop Nos.1 to 4, 33, 16, 22 and 24 of Vundrajavaram Mandal of West Godavari District and 13, 14 and 25 of Iragavaram Mandal of same district. When a notification was issued on 01.09.2015 for appointment of dealers for newly created shops at serial Nos.122 to 127 in respect of Vundrajavaram Mandal and 25 and 27 of Erigavaram Mandal, the present writ petition was filed.

3. The main grievance raised by the petitioners is that the new shops were created without following G.O.Ms.No.35 dated 17.09.2007 and the circulars issued by the Government from time to time.

At the stage of admission itself, the learned Government Pleader, after receiving instructions from the third respondent, submitted that respondents 4 and 5 submitted proposals for renewal of shops on 03.02.2015. Accordingly the proposals were submitted to the second respondent and the second respondent approved the proposals on 18.04.2015. The learned Government Pleader further submitted that the provisions of G.O.Ms.No.35 dated 17.09.2007 were strictly followed and there was no deviation in the instant case.

5. At this stage, the learned counsel for the petitioners submitted that since no notice was issued to the petitioners, they would not be in a position to know which cards were allotted to them. 6.

In the circumstances, this writ petition is disposed of at the admission stage directing respondents 4 and 5 to communicate to the petitioners the list of cards retained with the petitioners and the list of

cards which were transferred to the newly created shops. No order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
