HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 19126 of 2016 ORDER:

Heard learned counsel for the petitioner and Government Pleader for Home. With the consent of both the parties, the present writ petition being taken up for disposal at the admission stage itself.

The present Writ Petition came to filed seeking issuance of a Writ of Mandamus directing the respondents to take steps to conduct investigation in pursuant of Crime No.101 of 2016, registered for the offences punishable under Sections 341 and 352 IPC and declare the inaction of the respondents, as illegal and arbitrary.

Learned counsel for the petitioner submits that though the crime was registered in the month of March, 2016 for the offences punishable under Sections 341 and 352 IPC ie. Nonbailable offences, the accused are not arrested till date. Without going into the merits of the case and having regard to the nature of allegations made, the writ petition is disposed of directing the respondent-police to proceed with the investigation in Crime No.101 of 2016 of Pendurthy Police Station, in accordance with law and file a final report as expeditiously as possible, preferably, within a period of four (04) months from the date of receipt of a copy of the order, if not already filed. No order as to costs.

Consequently, miscellaneous petitions, if any, pending in

this Writ Petition shall stand closed.
