HON'BLE SRI JUSTICE S.V.BHATT W.P. No.18835 OF 2017 ORDER:

Heard Mr.Gangaiah Naidu, learned senior counsel for petitioner and the Assistant Government Pleader (Revenue). The petitioner prays for the following relief: "....Writ of Mandamus, declaring the action of the official-respondents 1 to 6 in interfering with the petitioner's landed property with an intent to help unofficial respondents 7 to 9 by dispossessing the petitioner from his landed property with an extent of Ac.11-18 cents, covered by R.S.Nos.1222/1 and 1222/2 of Tadikalapudi (V), Kamavarapukota (M), West Godavari District, without completing the enquiry under the provisions of A.P. Assigned Lands (Prohibition of Transfers) Act, 1977 by considering the petitioner's explanation and representation and appeal, dt.16-1-2017 E-File No.

234449 as illegal, arbitrary, biased, unconstitutional and against the principles of natural justice and consequently direct the official respondents 1 to 6 to protect the person and property of the petitioner from unofficial respondents 7 to 9..." On instructions, the learned Assistant Government Pleader submits that respondents 1 to 4 in fact, are not interfering. As regards respondents 7 to 9 is concerned, it is matter of consideration and decision by Civil Court, if at all a dispute is raised. Having regard to the statement made by the Assistant Government Pleader, learned Senior Counsel for the present does not press the prayer against respondents 1 to 6 and likewise reserves the right of petitioner to work out remedies against respondents 7 to 9 in a properly instituted proceeding or suit.

The writ petition is closed with the above observation. No order as to costs.
