THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 17158 of 2019 ORDER:
Learned counsel appearing for the fifth respondent, caveator, would assert that the petitioners are claiming relief against the fifth respondent, which is admittedly, a private institution, as such, the writ petition is not maintainable. He would also assert that if at all any relief is to be granted in favour of the petitioners, at best, the same could be granted only by the Civil Court.
When confronted, learned counsel for the petitioners seeks permission of this Court to withdraw the writ petition with liberty to the petitioners to avail the remedy as available to them under law.
Permission is accorded and the writ petition is dismissed as withdrawn with liberty as prayed.
