JUSTI CE SHAMEEM AKTHER W RI T PETI TI ON No.1 7 1 5 3 of 2 0 1 9 ORDER: { Per the Hon'ble the Chief Justice Sri Justice Raghvendra Singh Chauhan} The petitioner has filed this Habeas Corpus writ petition ostensibly on the ground that his wife Smt. Polepally Swapna has gone missing since 24.06.2019.

The Station House Officer, Shadnagar Police Station, has produced the detenue before this Court. This Court has had an opportunity to speak to Smt. Polepally Swapna. She informs this Court that she is 33 years old and mother of two children, who are aged 15 and 13 years. According to her, she has no desire to resume her cohabitation with her husband, the petitioner. In fact, she prefers to live alone. Moreover, according to her, she is looking for a job so that she can be financially independent of her husband. Once she finds a job, she will be more free to take her own decisions with regard to her family. Therefore, according to her, she does not wish to go back to the petitioner.

Since Smt. Polepally Swapna happens to be major, and since she has decided not to resume her cohabitation with the petitioner, this Court directs respondent No.5 to house Smt. Polepally Swapna back at the hostel where she is presently residing. With these directions, the writ petition stands disposed of. Pending miscellaneous petitions shall stand closed. There shall be no order as to costs.
