THE HONOURABLE DR. JUSTICE D. NAGARJUN CRIMINAL PETITION NO.4375 OF 2022 ORDER:- This Criminal Petition under Section 439(1)(b) Cr.P.C. read with 482 Cr.P.C. is filed seeking relaxation of the condition imposed by the Court below, by order dated 25.04.2022 in Crl.M.P.No.293 of 2022 in Crime No.10 of 2021 on the file of the Principal Sessions Judge, Warangal, to the extent that "the petitioner/A.4 shall be released on bail on his executing a persona bond of Rs.1,00,000/- with two sureties of like sum each to Rs.10,000/- with two sureties of like sum each and also relax the condition that one surety must be the local surety and another surety shall be from the native place of petitioner/A.4, verifying the genuineness of sureties and submitting of bank pass book and also submitting all his residential addresses of different places at Delhi and Kerala."

Learned counsel for the petitioner submitted that the petitioner is working as security guard and earning meager amount, therefore, it is very difficult for him to secure such huge amount. Hence, the conditions imposed by the Court below may be relaxed.

Learned Assistant Public Prosecutor submits that as the investigation is pending, the said condition may not be relaxed. 4.

In view of the said submissions made by counsel for the petitioner, this Court deems it appropriate to modify the order passed by the Court below to the extent of amount awarded by it i.e., instead of Rs.1,00,000/-, the petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) and the remaining conditions shall be intact.

With the above modification, this Criminal Petition is disposed of.
