HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.10969 of 2005 ORDER:

When this matter is taken up for hearing, the learned Counsel for the petitioner submits that the petitioner challenged the award dated 13.9.2001 passed by the Labour Court in I.D.No.100 of 1998 to the extent of denial of continuity of service and back wages, and now the petitioner attained the age of superannuation.

The learned Standing Counsel for the respondentCorporation contends that the labour Court has already granted continuity of service for the purpose of gratuity and rightly denied the back wages.

Having considered the above submissions, this Court is of the view that the Labour Court has rightly passed the award denying the back wages to the petitioner and that the petitioner has not pointed out any grave irregularity and illegality in the award impugned. There are no merits in this writ petition. Therefore, this Court is not inclined to interfere with the award impugned.

Accordingly, the Writ Petition is dismissed. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
