HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND HON'BLE SMT. JUSTICE T. RAJANI WRIT APPEAL NO.552 OF 2017 ORDER: (per Hon'ble the Acting Chief Justice Ramesh Ranganathan) This appeal, under Clause 15 of the Letters Patent, is preferred against the order passed by the Learned Single Judge in W.P. No.10808 of 2017 dated 27.03.2017. The appellant herein is the petitioner in the Writ Petition wherein he questioned the order of suspension dated 14.03.2017 passed by the Chairman of the Andhra Pradesh Grameena Vikas Bank. In the order under appeal, the Learned Single Judge observed that, against the order of the Chairman, an appeal lies to the Board of Directors under Regulation 49 read with Regulation 50 of the Andhra Pradesh Grameena Vikas Bank (Officers and Employees) Service Regulations, 2010; and as the petitioner had not exhausted the alternative remedy of appeal he saw no reason to exercise discretion to interfere.

While contending that it is also open to the appellant to invoke the jurisdiction of this Court, Sri Sriman, Learned Counsel for the appellant, does not dispute that the statutory Regulations provide for an appeal, against the order of suspension passed by the Chairman of the Bank, to the Board of Directors of the bank. In an Intra Court appeal, under Clause 15 of the Letters Patent, interference is justified only if the order under appeal suffers from a patent illegality. Dismissal of the Writ Petition on the ground that the appellant-petitioner has an effective alternative remedy of preferring an appeal does not suffer from any such infirmity. We see no reason, therefore, to entertain this
