THE HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 642 of 2009 ORDER :
A.P.S.R.T.C. and the Depot Manager, Guntur-II are the writ petitioners. The petitioners challenge the award dated 11.01.2008 in I.D.No.192 of 2004 on the file of the Labour Court, Guntur.
Through the award dated 11.01.2008, the Labour Court, while setting aside the order of removal, directed reinstatement of 1st respondent/workman with continuity of service and all other attendant benefits except backwages.
On 11.12.2012, on the request of learned counsel appearing for the petitioners, this Court granted four weeks time to complete service of notice on the un-served respondents with a default clause. From the docket proceedings, it appears, as no steps for getting the notice served on contesting respondent were taken by the petitioners, the writ petition is dismissed for default against the 1st respondent.
Taking note of dismissal of the writ petition against the 1st respondent, the Writ Petition is dismissed as the award has become final against the 1st respondent. The
petitioners, however, are given liberty if so advised to file petitions, in accordance with law, for regularizing the service of notice and setting aside the default order, etc. No order as to costs.
Consequently, interim order granted by this Court on 11.02.2009 is vacated, and miscellaneous petitions, if any, pending in the writ petition shall stand dismissed. ____________________ JUSTICE S.V.
