THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9215 OF 2016 ORDER:

This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioner/A.1 seeking bail in crime No.14 of 2016 on the file of the P.S., Mothugudem, East Godavari District, registered for the offence under Section 8(c) read with Section 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act (NDPS Act).

Heard and perused.

The allegation against the petitioner/A.1 is that the petitioner/A.1 and A.2 were found in illegal possession of 200 kgs., of Ganja. Learned counsel for the petitioners submits that the petitioners have not committed any offence and that they have been falsely implicated in the present case. He prays this Court to grant bail to the petitioners.

Considering the fact that the quantity of Ganja, which was found in possession of petitioner/A.1 is commercial quantity, this Court is not inclined to grant bail to the petitioner/accused. The criminal petition is accordingly dismissed. _____________________ JUSTICE RAJA ELANGO 04.07.2016 pln
