THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.7750 of 2014 ORDER:

This writ petition was filed challenging the action of respondents in not considering the candidature of petitioner for appointment in the respondent No.1 Corporation under the Bread Winner Scheme/compassionate grounds in accordance with the G.O.Ms.No.2, Transport, Roads & Buildings (TR.II) Department dated 05.01.2013.

A counter affidavit is filed on behalf of the respondents disputing the averments made in the affidavit filed in support of the writ petition.

In view of the nature of disposal of the writ petition and request made by the learned counsel for petitioner, this Court purposefully did not advert to the averments made in the affidavit and the averments made in the counter affidavit. Learned counsel for the petitioner submits that the petitioner has not received the monetary benefits, consequent to the death of his father and he belongs to the Schedule Caste community. However, in the facts and circumstances of the case, liberty is given to the petitioner to submit a representation for considering the case of petitioner for appointment under the compassionate grounds and the respondents are directed to consider the same in accordance with law, as and when such representation is made.

Accordingly, this Writ Petition is disposed of. No order as to costs. Miscellaneous Petitions pending, if any, shall stand closed.
