HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.17159 OF 2019 ORDER:

This writ petition is filed aggrieved by action of respondents in harassing and interfering with the life and liberty of petitioner without following due process of law. Learned Assistant Government Pleader for Home produced written instructions and relevant paras of the same reads as under:

"It is submitted that the wife of the petitioner namely Smt.Lavanya who is respondent No.3 lodged a complaint on 23.06.2019 with the respondent No.1 Station House Officer, Women Police Station, Warangal Urban, stating that her marriage was performed with the petitioner herein on 01.03.2017. After the marriage the petitioner and others harassed mentally and physically for additional dowry. Pursuant to the complaint of the respondent No.3, the respondent No.1 made entry into the General Diary and called the petitioner for the purpose of enquiry/counseling. Accordingly, the petitioner approached on 24.06.2019 and promised to approach on 03.07.2019, but he did not attend the counseling. Thereon, the respondent No.1 tried to secure the presence of the petitioner on 02.08.2019 and 05.08.2019 through phone and deputing staff to the house of petitioner for the purpose of enquiry/counseling. The petitioner instead of attending the counselling, filed the present Writ petition with baseless allegations.

It is submitted that except receiving the complaint from the respondent No.3 against the petitioner dated 23.06.2019, the respondent No.1 did not harass or interfered with the life and liberty of the petitioner at any point of time. It is submitted that mere calling the petitioner for the purpose of

enquiry/counselling, does not interference of the respondent No.1.

It is submitted that the contention of the petitioner that the respondent No.1 threatened the petitioner over phone on 2.8.2019 and 5.8.2019 to join the matrimonial company with the respondent No.3 or else the petitioner and his family members will be implicated in false criminal cases.

As stated supra, the respondent No.1 did not harass, threaten or interfered with the life and liberty of the petitioner at any point of time.

It is submitted that the present Writ Petition has been filed on apprehension only and liable to be dismissed."

But, learned counsel for the petitioner submits that respondent-police are harassing and threatening the petitioner without registration of any crime.

Recording the written instructions stated supra filed by learned Assistant Government Pleader, the writ petition is disposed of directing the respondent-police not to interfere with the life and liberty of the petitioner except in accordance with law.
