HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 18991 OF 2015 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the parties.

Mr. Shafath Ahmed Khan, learned Standing Counsel for the Wakf Board, who is present in the Court, submits that under Section 36 of the Wakf Act, 1995 (for short, 'the Act'), the petitioner can approach the Wakf Board for similar prayer as made in the representation dated 27-04-2015.

Having confronted with this, learned counsel for the petitioner prays for withdrawal of the petition with liberty to the petitioner to approach the Board under Section 36 of the Act for notifying the property mentioned by him in the representation as a wakf property. Writ petition is disposed of as withdrawn with liberty as prayed. While granting liberty, we shall not be understood to have issued any direction as such to the Board. The Board shall consider the petitioner's application on merits in accordance with law. Miscellaneous petitions, if any, also stand disposed of. _________________________ DILIP B.
