The petitioner challenges the order in proceedings in Rc.No.628/CS/2017, dated 07-04-2017, whereunder and whereby the authorization of petitioner's fair price shop was suspended on 07-04-2017.

Learned counsel for the petitioner submits that though the petitioner has filed appeal along with stay petition, but no orders are passed in the said appeal.

This Court in K.Nirmala v. The Revenue Divisional Officer, Ananthapur District1, has taken a view that suspension of authorization of fair price shop cannot be normally continued beyond (90) days.

In view of the same, the impugned order is set aside. However, this order will not preclude the respondent-authorities from passing final orders after concluding enquiry after affording opportunity of hearing to the petitioner. Accordingly, the writ petition is allowed to the extent indicated above.
