The petitioners are purchasers of small extents of lands (plots of 200 square yards each) for house site purpose in the layout prepared in Survey No.65/A situated in Jagannadhapuram Village, Sattupalli Mandal, Khammam District, and the said lands came to be acquired under a notification dated 06.12.2017 issued under Act 30 of 2013. It is their grievance that though they purchased their lands on a 'square yard' basis, the respondent authorities are calculating the compensation as applicable for agricultural lands. Heard learned counsel for the petitioners, and the learned Assistant Government Pleader appearing for the respondents. Learned Assistant Government Pleader, on the basis of written instructions dated 09.08.2019 received from Special Deputy Collector (LA), IPT & Railways, Khammam, submits that after conducting of Award enquiry, an Award came to be passed on 11.02.2019 and notices have also been issued to respective parties on 24.07.2019 calling upon to receive the compensation amount in the shape of Bankers' Cheque, but the petitioners did not choose to receive the cheques.
Having considered the respective submissions, and having regard to the fact that the Award had already been passed, the remedy available to the petitioners is to approach the competent authority under Section 64 of the Act. In those circumstances, the writ petition is disposed of by giving liberty to the petitioners to approach the competent authority under Section 64 of the Act, who shall consider their case in accordance with law. As the petitioners have approached this Court out of ignorance, subject to the condition of the
petitioners approaching the competent authority invoking Section 64 of the Act, within four weeks from the date of receipt of a copy of this order, their claims shall be considered without raising the objection of limitation.
