ORDER

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioner/Accused No.5 in the event of her arrest in Crime No.350 of 2022, on the file of Jawaharnagar Police Station, Rachakonda, for the offences punishable under Sections 307, 506 and 504 read with 34 of Indian Penal Code. 2.

The brief facts of the prosecution case are that A-1 to A-4 along with the petitioner/Accused No.5, who is named herself as human right activist, hatched a plan and according to their plan on 08.04.2022 between 18.00 and 8.30 hours, they all went to the house of the de facto complainant with an ill intention to beat the de facto complainant, entered into the house, threatened the de facto complainant and beat her with hands and wooden sticks, due to which, the de facto complainant sustained injury on the head, later A-1 to A-5 fled away from the spot. Initially the case was registered under Sections 323, 324, 504 and 506 read with 34 I.P.C., and subsequently, basing on the statements, collected evidence and circumstances, the Section of law is altered as 307 I.P.C.. 3.

Learned counsel for the petitioner submitted that the petitioner is a woman and she is no way connected with the family affairs of the de facto

GAC, J Crl.P.No.4377 of 2022 complainant. Further, the petitioner was falsely implicated in this case as she is a friend of Accused No.3.

On the other hand, learned Assistant Public Prosecutor submitted that so far six witnesses were examined and the investigation is in progress.

Taking into consideration of the fact that the petitioner is a woman, this Court is inclined to grant anticipatory bail to the petitioner/Accused No.5.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.5 shall be enlarged on bail in the event of her arrest subject to the following conditions:

i) The petitioner/Accused No.5 is directed to surrender before the XXIII Metropolitan Magistrate, Medchal, Cyberabad, within a period of ten (10) days from today, and on such surrender, she shall be enlarged on bail on her executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties for the like sum each to the satisfaction of the said Court.

ii) The petitioner/Accused No.5 shall appear before the Station House Officer, Jawaharnagar Police Station on every Sunday between 10.00 AM and 02.00 PM till filing of the charge sheet.

GAC, J Crl.P.No.4377 of 2022 iii) The petitioner/Accused No.5 shall co-operate with the investigation.
