This writ petition is filed challenging the action of the 2nd respondent in issuing provisional state wide seniority list vide Rc.No.05/A1-5/2016-18, dated 12.04.2018 to all the Principals of APREI Society, without taking into consideration the representation dated 01.08.2017 of the petitioners, as illegal and arbitrary and consequently direct the 2nd respondent to publish the final state wide seniority list duly considering the representation of the petitioner for restoration of state wide seniority as per date of appointments of the employees to secure the ends of justice. Learned counsel for the petitioner submits that the writ petition can be disposed of permitting the petitioners to file objections on the impugned provisional seniority list dated 12.04.2018 and also directing the competent authority to consider the said objections.
Heard Sri Umashankar Lokanadham, learned Standing Counsel for the 2nd respondent.
It is to be seen that the petitioner submitted representation dated 01.08.2017 and thereafter the impugned provisional seniority list dated 12.04.2018 was issued calling for objections. As such, it is for the petitioner to file fresh representation raising all his
objections instead of relying on his earlier representation dated 01.08.2017.
In view of the same, the petitioners are permitted to file fresh objections within two weeks from the date of receipt of a copy of this order and on such objections being filed, the competent authority is directed the consider the same as per rules. Accordingly, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
