HON'BLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.17186 of 2019 ORDER :
There is no representation on behalf of the petitioner. The prayer sought in the writ petition is as under: "..... this Hon'ble Court may be pleased to issue a writ order or direction more particularly one in the nature of Writ seeking Writ of Mandamus declaring the action of the respondent Nos.2 and 3 in not taking any against the illegal constructions of respondent Nos.4 to 6 on H.No.2-295 to 2-301 of Mothkur Municipality, Yadadri Bhongir District, in pursuance of the representation made by the petitioners dt.02.08.2019 and 03.08.2019 is illegal, arbitrary and consequently direct respondent Nos.2 and 3 to stop illegal constructions on H.No.2-295 to 2-301 of Mothkur Municipality, Yadadri Bhongir District, raised by respondent Nos.4 to 6 and pass such other order or orders ....."
The Registry has placed on record an Office Note stating that on 13.08.2019 this Court passed the following order : "It is the assertion of the petitioner that respondent Nos.4 to 6 are making constructions on the subject land belonging to the third respondent-Mothkur Municipality, Mothkur, Yadadri Bhongir District, rep. by its Commissioner. In fact, the petitioner does not have any interest in the subject land. In the light of the above, the writ petition is required to be treated as PIL subject to the affidavit filed by the petitioner satisfying the conditions of PIL.
The matter is to be listed before the Division Bench." It is also mentioned in the Office Note that the learned counsel for petitioner did not turn up to the Section to receive the bundle to comply with the directions of this Court
PKR,J W.P.No.17186 of 2019 dt.13.08.2019 till date, though a notice dt.16.08.2019 was also placed in the Notice Board.
From this, it appears that the petitioner is not interested to prosecute the matter, diligently. Therefore, the writ petition is dismissed for non-prosecution. No order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
