O R D E R

This writ petition is filed for a writ of mandamus declaring the action of the respondents in not considering the case of the petitioner for appointment of Cleaner/Conductor or for any suitable post, as illegal and arbitrary and for a consequential direction to the respondents to consider the case of the petitioner for any suitable post on compassionate grounds. This Court on 20.01.2004 granted interim order directing the respondents to consider the representations made by the petitioner on 08.08.2002 and 13.10.2002 for compassionate appointment.

Counter affidavit is filed by the respondents stating that the application made by the petitioner on 08.08.2002 was considered and in pursuance to the same, the proceedings dated 22.11.2002 were issued stating that there are no vacancies and advised the petitioner to avail additional monetary benefit in lieu of employment under Bread Winner Scheme.

In view of the averments in the counter affidavit, the grievance of the petitioner is redressed. However, it is open to the petitioner to either challenge the proceedings dated 22.11.2002, if not already challenged or to avail additional monetary benefit in lieu of employment. Accordingly, the writ petition is disposed of. No costs. As a sequel, miscellaneous petitions pending if any, shall stand closed. ____________________________ A.RAJASHEKER REDDY,J Date: 28.09.2015 dv
