HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.2435 of 2015 ORDER:

There is no representation on behalf of the petitioner. The prayer sought in the writ petition is as under: "... to issue a writ, order or direction more particularly one in the nature of writ of Mandamus declaring the inaction of the 3rd respondent in investigating into the offences committed by the respondents No.4 of FIR No.840 of 2014 dated 21.08.2014 on the file of KPHB P.S., Cyberabad while filing charge sheet in crime in STC.No.2736 of 2014 dated 26.06.2014 as illegal, contrary to law, bias, arbitrary and opposed to Article 14 and 21 of the Constitution of India." Learned Government Pleader appearing for respondent Nos.1 to 3 placed on record copies of Memorandum dated 09.04.2015 issued by the Deputy Commissioner of Police, Madhapur Zone, Cyberabad, as well as the final report along with the notice served on the petitioner.

From a perusal of the said papers, it is revealed that on the complaint lodged by the petitioner a case in Crime No.840 of 2014 for the offence under Sections 323, 324 and 506 IPC was registered. After investigation, a final report was filed by the SubInspector of Police, KPHB Police Station, Cyberabad, before the II Additional Junior Civil Judge-cum-XIX Metropolitan Magistrate, Kukatpally at Miyapur referring the case as 'false'. The copy of the said final report is also served on the petitioner vide endorsement dated 04.07.2015.

In that view of the matter, this Court is of the opinion that no further cause would survive in the writ petition. Accordingly, the writ petition is dismissed. No costs. Miscellaneous petitions, if any, shall also stand dismissed. _____________________ P. KESHAVA RAO, J Date: 15.11.2019.
