THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION NO.8013 OF 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking to issue writ of mandamus declaring the action of the respondents 1 and 2 in interfering with the saw mill business of the petitioner without following due process of law and orally directing the petitioner to stop the saw mill business and thereby forcibly preventing him to run the saw mill by removing the gutka in spite of orders of this Court in W.P.No.338588 of 2013, dated 03-01-2014 and appeal before the Conservator of Forest, Kurnool is pending, as illegal and arbitrary and consequently direct the respondents not to interfere with the saw mill business of the petitioner.
2. Learned counsel for the petitioner seeks permission of this Court to permit the petitioner to withdraw the writ petition with a liberty to file fresh writ petition. Permission is accorded. 3.
Accordingly, the Writ Petition is dismissed as withdrawn granting liberty as prayed for. No order as to costs. Miscellaneous petitions, if any pending, in this writ petition shall stand closed.
