This Criminal Revision Case is filed by the petitionerrespondent aggrieved by the docket order, dated 31.03.2026 in Crl.M.P.No.242 of 2025 in M.C.No.149 of 2021 passed by the learned Judge, Family Court, Ranga Reddy District at L.B.Nagar, whereunder and whereby, the petitioner filed an application under Section 70 (2) of Cr.P.C. seeking to recall NBW issued against him on 27.06.2025, was dismissed.

Heard Sri Laxmaiah Kanchani, learned counsel for the petitioner and perused the record.

Learned counsel for the petitioner would submit that for non-payment of arrears of maintenance amount of Rs.8,25,000/-, the learned Family Court issued NBW on 27.06.2025 to the petitioner; that in the month of March, 2025 the petitioner paid an amount of Rs.1,00,000/- for payment of school fees and other expenditures to respondent No.2; as such he could not pay the entire arrears of maintenance amount as he is earning meager amount of salary; that the mother of the petitioner is suffering from Cancer and the petitioner incurred huge amount for her treatment, but she expired recently and hence, he prays this Court to reduce maintenance amount.

Having regard to the submissions made by learned counsel for the petitioner and taking into consideration the facts and circumstances of the case, the NBW issued against the petitioner shall be recalled on condition of petitioner paying arrears of maintenance of Rs.2,00,000/- (Rupees Two lakhs only) to respondent No.2 within a period of two months from the date of receipt of a copy of this order.

With the above observation, the Criminal Revision Case is disposed of.

Miscellaneous applications, if any pending, shall stand closed.
