HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.13672 of 2017 O R D E R:
This writ petition is filed by the petitioner challenging the action of the 5th respondent in detaining the petitioner without any complaint under the influence of the 6th respondent on 08.04.2017 and forcing the petitioner to vacate the schedule property, even though the petitioner lodged a complaint and FIR No.416 of 2016 was registered against the 6th respondent on 04.07.2016.
2. Since the relief sought for in the writ petition pertains to the alleged excess of authority committed by the 5th respondent, this court is not inclined to interfere with it through the present writ petition, as it involves verification of facts, which can be done only by the higher authorities of the 5th respondent.
3. In the circumstances, the petitioner is given liberty to approach the 3rd respondent, who shall look in to the complaint of the petitioner as and when submitted and take necessary action against the 5th respondent, in accordance with law.
4. The writ petition is, accordingly, disposed of. No order as to costs. Pending miscellaneous petitions, if any, shall stand dismissed in consequence.
