THE HON'BLE SMT JUSTICE T.RAJANI CRIMINAL PETITION NO.2756 OF 2011 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in Cr.No.304 of 2010 on the file of the Station House Officer, Chaderghat Police Station, Hyderabad City.

Heard the learned counsel for the petitioners, learned counsel for the 1st respondent and the learned Public Prosecutor appearing for the 2nd respondent.

Learned counsel for the petitioners contends that there is a delay of seven months in filing the complaint and even from the statement of the complainant, it can be understood that the complaint is totally false as the accused have attended the Court on the same day, the date on which, the death of the complainant's husband occurred. But the averments of the petition would show that there are specific allegations made against all the accused that they have gone to the house of the complainant and threatened the lady, who was in charge of the keys of her house. When such is the nature of allegations, merely going by fact of delay, to quash the proceedings is not advisable. However, the arrest of the petitioners is stayed.

With the above observation, the Criminal Petition is disposed of. Miscellaneous petitions, if any pending, in this petition shall stand closed.
