This court made the following :
THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.37269 of 2015
ORDER :
According to petitioners, they were employed by the Columbia Security Services to work as security guards in Jawaharlal Nehru Technological University, Kukatpally, Hyderabad (3rd respondent). According to the petitioners earlier there was a dispute regarding their services and petitioners and several other employees engaged by the Columbia Security Services, were not allowed to discharge their duties and were not allowed to enter into the premises of 3rd respondent. Petitioners complained to the Conciliation Officer & Joint Commissioner of Labour (Hyderabad Twin Cities), RTC Cross Roads, Hyderabad (2nd respondent) and in pursuant to the directions of the 2nd respondent, other employees were restored to duty but the petitioners were not restored. By relying on the letter of the 2nd respondent dated 18.08.2015 addressed to the Registrar, JNTU, Kukatpally, Hyderabad, and contending that petitioners were not allowed to resume their duties, this writ petition is filed.
2. When the matter is taken up, learned Standing counsel produced documents to contend that the contract with Columbia Security Services was terminated and the Security Service is now entrusted to M/s.Karthikeya Security Services. Petitioners having been engaged by Columbia Security Services, which is not providing security services to the 3rd respondent, no relief can be granted and no claim can be made against the 3rd respondent.
3. At this stage learned counsel for petitioners sought leave to prosecute appropriate remedy. Since the petitioners seeks to avail alternative remedy as available for enforcement of the letter of conciliation officer dated 18.08.2015, without expressing any opinion on merits, the writ petition is disposed of, granting liberty to the petitioners to work out their remedies as available in law. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed. __________________ P.NAVEEN RAO,J 19th November, 2015 Rds
