HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO Crl.P.M.P.No.6060 of 2015 AND CRIMINAL PETITION No.6153 of 2015 ORDER :
This criminal petition is filed by the petitioners/A.1 and A.2 under Section 482 Cr.P.C seeking to quash the proceedings in C.C.No.302 of 2013 on the file of the V Metropolitan Magistrate, Anakapalle, Visakhapatnam District, for the offences punishable under Sections 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961 (for short, 'the Act').
2. Pending the criminal petition, Crl.M.P.No.6060 of 2015 is filed by the de facto complainant-2nd respondent with joint memo seeking permission to compound the criminal case stating that the matter is amicably settled between the parties out side the Court.
3. It is represented that with the intervention of elders, disputes between the parties have amicably settled and as per compromise, the de facto complainant is going to settle the issues including the divorce O.P. pending before the Family Court, Ranga Reddy, by referring the same to the District Legal Services Authority as they were living together.
4. The de facto complainant and petitioners/A.1 and A.2 are present. Having heard the parties, permission is thereby accorded as the parties stated that they have amicably settled the matter to purchase peace.
Accordingly, the offences are compounded in terms of their compromise at the instance of the de facto complainant since present with the petitioners/A.1 and A.2.
5. Accordingly, Crl.P.M.P.No.6060 of 2015 is allowed. Consequently, the criminal petition is allowed and all the proceedings relating to C.C.No.302 of 2013 on the file of the V Metropolitan Magistrate, Anakapalle, Visakhapatnam District, are quashed against the petitioners. The bail bonds of the petitioners, if any, shall stand cancelled.
6. Miscellaneous petitions pending, if any, shall stand dismissed.
